“If you are not seeking to represent yourself you’re making a wise decision.“

“Okay. Well, I’ve already told you, as you acknowledged earlier today, that any individual who chooses to proceed on his own was taking enormous risks and subjecting himself to a considerable disadvantage.”

In principle, the alternative to you having another lawyer derived from that method is to represent yourself. I don’t know whether that’s what you’re seeking. I really don’t understand what you’re seeking. But if that’s what you’re seeking, then I would do my best to bang you on the head and kick you on the skins(sic), and I’m speaking figuratively, I don’t mean that literally, talk you out of that. Because it would be totally against your interests.

JUDGE MATZ
Mr. Nicolaysen is your lawyer and he’s proceeding under the authority of the court.
ACCUSED:
No, he’s not my lawyer. He’s your lawyer. I have not given you authority to speak for me. Your silence acknowledges that.
JUDGE MATZ
He has no duty to acknowledge that and you have no authority to interfere with that.
THE FLIP-FLOP.

THE BOTTOM LINE IS THAT I’M TELLING YOU THAT IF YOU WANT TO BE REPRESENTED BY COUNSEL, I WOULD HONOR THAT CHOICE, AND IF YOU WANT TO REPRESENT YOURSELF, I WOULD BE REQUIRED TO HONOR THAT CHOICE.

Judge Howard Matz
JUDGE MATZ:
“Well, I am letting you speak. It’s important to me that I let you speak as well as, I think, in most respects your right to speak.
If you had said to me judge, I want to be my own lawyer, I would have spent a half hour explaining to you why that would be an absolutely mistaken decision on your part. I could take you through all the different little and big aspects of fighting off the government at the trial and before the trial in this case, that you need a lawyer to handle.”

“SO A PRUDENT THING TO DO FOR SOMEBODY IN YOUR SITUATION WOULD BE IS I’LL TAKE MY BEST SHOT AT IT. YOU CAN TAKE YOUR BEST SHOT AT BEING YOUR OWN LAWYER, IF YOU WANT, OR YOU CAN BE A LAWYER.”
