Duarte why she would give a man; whom she was prosecuting as a assistant U.S. attorney for identity theft of approximately 1900 social security numbers, an additional 6000 social security numbers, and a lot more to go with it, like matching names, phone numbers, home addresses, etc.  And then not tell anyone.  Oh my!

Remember this folks, when Associate Justice Elena J. Duarte is not smiling she is lying, engaging in secret hearings and helping a fraud on the court. I mean, most likely.   Better make that definitely!

LOS ANGELES — “The law is ‘pretty’ clear and I did not follow it.”

With that excuse, Judge A. Howard Matz of the United States District Court for the Central District of California in Los Angeles admitted his incompetence.

On Monday, following a trial earlier, Judge Matz issued a  decision that said the defendant, had no right to represent himself.  Though he said the trial should not have been needed once all the facts were on the table, Judge Howard Matz complimented the lawyers, noted that “colorful” characters were involved, and added, “Presiding over the trial was a pleasure for this court.”

“All the great things are simple, and many can be expressed in a single word: freedom, justice, honor, duty, mercy, hope.”

Jose L. Pineda v. GMAC Mortgage. We’ve seen too many cases like it. A big bank makes an illegal foreclosure on a home. In this case, the homeowner sues — and wins, thanks to Judge A. Howard Matz. Score one for the 99%. Or perhaps not. It’s the casual handling of the bank’s crimes that caused a stir, sparking an online petition for the impeachment of Matz, who was appointed to the Central District of California by President Bill Clinton in 1997.

In delivering justice for the little guy, Matz excused GMAC’s illegal claim to the home as “misrepresentations that may have been inadvertent and unintentional and short of fraud, but [are] extremely aggravating.” Stop. Right. There. Misrepresentations = lies to steal a house. That’s a serious crime. The judge is clearly saying that evidence leads him to believe that GMAC has committed a crime. However, if GMAC walks away from this one, His Honor will forget the matter, and even be willing to consider the crime “inadvertent.” As if ignorance of the law could somehow free GMAC from prosecution. Well, it did.

And Judge Matz is also claiming ignorance of the law as an excuse.

Matz actually “threatened to blow the whistle” on the cover-up. He bluntly told GMAC’s attorney,

“If this case doesn’t settle and settle quickly, I am prepared to…take this case as a paradigm for a much larger problem, a much larger financial, regulatory and litigation problem that can stem — that has stemmed from the way these loans were issued, packaged, [and] securitized…Now, you tell your clients that unless this case can be disposed of, this case is going to be something that’s going to go far beyond this case.”

Lawyer Charles Lincoln writes that Matz obviously

“possessed full information regarding the truth of the illegality of the foreclosure epidemic as a crime against the American people. Can the judge actually be doing anything other than threatening GMAC with ‘telling the truth’ about misrepresentation in non-judicial mortgage foreclosure proceedings? What does this tell us about Judge A. Howard Matz’s versions of reality and truth?“

Maybe Judge Howard Matz was afraid he would be Davised. Or that the Mob would wack ‘em.   Well then “most likely” the mob owns your home. Because in Judge Howard Matz’ courtroom anything is possible. Except experts, evidence, truth, honor and due process. And a Doctor holding his shiny certificate.

I mean, probably.

My countrymen have been called a Nation of Cowards. Well, they could learn a thing or two from B.J. and Julia Davis by watching the Documentary called Top Priority: The Terror Within. It tells the story of BJ and Julia Davis’ fight against the rouge agents of the United States. This man and woman are national heroes in my opinion. And B.J. is one courageous and tenacious guy with a ton of self-restraint and courage.

After watching the documentary  “Top Priority: The Terror Within” last night I could only walk away with one of two emotions I struggled with inside, profound sadness and anger. I left with the former. Watching this woman cry over the innocent loss of her father, by these unlawful and illegal acts of a not-so-intrepid flock of government gulls and toadies claiming to be agents of the United States of America, sickens me. They were truly the cowards, not this great nation. More time, manpower and military might is utilized to attack Julia Davis and B.J. Davis than the number of US Navy SEALS on the ground during the assault of Osama Bin Laden’s compound in Pakistan. The scale of the assault on their home boggles and bends one’s mind.

I too was subjected to an unusual process that would boggle one’s mind, too. A most “unusual case.” A process that involved both physical, psychological torture and manipulation of the law by several of the exact players in “Top Priority: The Terror Within.”

Julia and B.J. Davis make me proud to be an American. They give me the strength to continue to speak out.  How they endured their ordeal is an example to us all.  This movie is a must watch for any and all Americans who believe in truth, justice, the Constitution and fundamental rights.  This movie clearly exposes those Americans who believe the exact opposite, like Judge A. Howard Matz and Debra Wong Yang, and it leaves this author wondering who will bring these people to Justice?

While the Davis’ were designated a “Top Priority,” my website and speech on Killercop.com was secretly designated a “Special Interest.“  So someone is lying to the court.  BUt that seems to be par for the course in this unusual case.

The facts remain the same, dirty deeds thrive under the cover of darkness and sunshine is the best disinfectant.
