“We decline to determine whether the trial courts error was harmless, because the order of commitment is moot. We have chosen to address the issues raised  because they involve matters of public interest that are likely to reoccur yet normally evade review; however, there would be little value in a harmless error analysis.” It hardly needs repeating that “commitment for any purpose constitutes a significant deprivation of liberty that requires due process protection.” (Addington v. Texas (1979) 441 U.S. 418, 425 [60 L.Ed.2d 323].)

The risk of a wrongful commitment is particularly insidious given the public misconceptions about mental retardation and mental illness.

USE OF FORCE IN RESISTING ARREST
PURPOSE:
These statutes provide that the arrestee is not justified in the use of force in resisting any arrest, whether or not such arrest is lawful.
KEY ELEMENTS:
1. Should eliminate the defense of “unlawful arrest” from those available to a person charged with resisting an arrest by using physical force or a battery charge associated with the arrest.
2. Should contain language making the use of such force “unjustified” or “unauthorized” regardless of the lawfulness of the arrest.
3. Should apply whenever the arrestee should reasonably know that the person making the arrest is a law enforcement officer, and should be an objective standard (not requiring proof of the arrestee’s state of mind).

EXAMPLES:
CONNECTICUT GENERAL STATUTES,
SECTION 53A-23
“A person is not justified in using physical force to resist an arrest by a reasonably identifiable peace officer, whether such arrest is legal or illegal.”

FLORIDA STATUTES,
SECTION 776.051(1)
“A person is not justified in the use of force to resist an arrest by a law
enforcement officer who is known, or reasonably appears, to be a law
enforcement officer.” Period.

Woe unto you.  And woe unto them cops.  And especially woe unto thee for penning that treason.

The Fantasy World Of Judge Kozinski and Judge Matz

Explaining my predicament to someone who’s programming is complete has proven very difficult. Most are content to live in the fantasy world that has developed over the years. Nowadays I prefer written communications. For the record.

The scariest moment is always just before you start to tell the truth.

Frivolous? Maybe? But I doubt it. 

Unusual? Possibly. But, again, I doubt it.

Do I ‘plan on continuing to publish’ not guilty? Absolutely, 100%.
